Terms of Service
These terms govern your use of NomaPort products, services, website and subscriptions. By using NomaPort, you agree to these terms and our related policies.

1. About these Terms
These Terms of Service ("Terms") govern access to and use of the NomaPort website at https://nomaport.com, customer accounts, software subscriptions, configuration services, hardware bundles and related support offered by NomaPort ("NomaPort", "we", "us", "our").
By creating an account, placing an order, requesting a pilot, subscribing to a service or otherwise using NomaPort, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Acceptable Use Policy, Cookie Policy and product-specific notices.
If you use NomaPort on behalf of an organisation, you represent that you have authority to bind that organisation. In that case, 'you' and 'your' refer to the organisation.
2. Who we are
NomaPort provides practical security enablement for independent professionals and small teams, including preconfigured connectivity devices, device posture services, education modules, secure workflow guidance and privacy-aware AI tools.
Registered company and VAT details are provided on commercial invoices, order confirmations and enterprise agreements. For general enquiries contact hello@nomaport.com; for legal matters contact legal@nomaport.com.
3. Eligibility and accounts
You must be at least 18 years old and capable of entering a binding contract to use paid services or place hardware orders. You are responsible for maintaining the confidentiality of your account credentials, magic-link access and any API keys you create.
You must provide accurate registration information and keep it up to date. We may suspend or terminate accounts that contain false information, are used in breach of these Terms or pose a security risk.
- Account sign-in is provided via email magic links sent through our email provider.
- API keys must be stored securely and must not be embedded in public repositories or client-side code.
- You are responsible for all activity under your account unless you notify us promptly of unauthorised access.
4. Services and products
NomaPort offerings may include hardware devices and bundles (such as Roam hotspots and kits), software subscriptions (such as Check, Learn, AI, Vault and Comms), configuration and onboarding services, team dashboards, knowledge modules and partner-supported workflows.
Descriptions, specifications, pricing, availability and delivery timelines on our website or in proposals are indicative unless confirmed in a written order or statement of work. Features may evolve over time. Where a material change affects an active paid subscription, we will provide reasonable notice when required by law or contract.
4.1 Hardware and bundles
Hardware may include third-party devices configured and tested by NomaPort unless we explicitly state otherwise. Device models, cellular bands, eSIM or SIM compatibility, power adapters and regional certifications may vary by country.
You are responsible for lawful import, local radio regulations, compatible SIM or data plans and safe use of hardware in your environment.
4.2 Software subscriptions
Subscription services are billed on a recurring basis through Stripe unless otherwise agreed. Access to entitled products, knowledge modules and API features depends on active subscription status.
Some features require connected apps, supported devices or compatible third-party services. We do not guarantee uninterrupted availability of third-party platforms.
4.3 Professional services and pilots
Pilot programmes, enterprise deployments, VPN compatibility testing and custom onboarding may be subject to separate statements of work, pilot terms or enterprise agreements. If there is a conflict between those documents and these Terms for a specific engagement, the engagement-specific document prevails.
5. Orders, pricing and payment
Prices are shown in the currency indicated at checkout or in your quote and may exclude taxes, shipping, customs duties, mobile data plans and third-party fees unless stated otherwise.
Payment for subscriptions and applicable hardware is processed by Stripe or another payment provider we designate. By submitting payment information you authorise us and our payment provider to charge the applicable fees.
Failed payments may result in suspension of subscription access after reasonable notice. Hardware orders may be cancelled if payment cannot be collected before shipment.
- Subscription renewals occur automatically until cancelled through the billing portal or as otherwise described at purchase.
- One-time purchases, deposits and service fees are non-recurring unless explicitly labelled as subscriptions.
- We may correct pricing errors before accepting an order and will notify you if an order cannot be fulfilled at the listed price.
6. Delivery, risk and acceptance
Estimated delivery dates are not guaranteed. Title and risk of loss for hardware pass to you upon delivery to the carrier unless otherwise required by mandatory law.
You must inspect hardware promptly on receipt and notify us of visible damage or missing items within seven (7) days. Configuration services are deemed accepted when delivered or when you begin operational use, whichever occurs first, unless a separate acceptance process applies.
7. Acceptable use and restrictions
Your use of NomaPort is subject to our Acceptable Use Policy, VPN Responsibility Notice, Fair Use & Data Policy and AI Data Handling Notice. You may not use NomaPort for unlawful activity, network abuse, harassment, malware distribution, unauthorised access, rights infringement or attempts to bypass security controls.
We may investigate suspected violations and suspend or terminate access where necessary to protect users, partners, infrastructure or legal compliance.
8. Third-party services
NomaPort integrates with or helps configure third-party services such as VPN providers, cloud storage, communication tools, AI model providers, analytics platforms, email delivery and payment processors. Those services are governed by their own terms and privacy policies.
We are not responsible for third-party outages, policy changes, account suspensions or data handling outside our control, except where mandatory law provides otherwise.
9. Intellectual property
We and our licensors retain all rights in the NomaPort brand, website, documentation, dashboards, software, configurations, training content and other materials. Subject to these Terms and active entitlements, we grant you a limited, non-exclusive, non-transferable licence to use NomaPort services for your internal business or personal professional use.
You may not reverse engineer, resell, sublicense, scrape or misrepresent NomaPort materials except where permitted by mandatory law or written agreement.
10. Confidentiality and customer data
Each party may receive confidential information from the other. You must protect credentials, unpublished configurations and non-public documentation. Our handling of personal data is described in the Privacy Policy.
You retain ownership of content you submit to NomaPort services, including documents processed in NomaPort AI subject to the AI Data Handling Notice. You grant us the rights necessary to host, process, configure and support the services.
11. Warranties and disclaimers
Hardware warranty, returns and replacement terms are set out in our Warranty, Returns & RMA policy. Software and configuration services are provided on an 'as is' and 'as available' basis to the maximum extent permitted by law.
NomaPort reduces common security and privacy risks through secure configuration, guidance and partner-supported workflows. We do not guarantee anonymity, immunity from attack, uninterrupted service, error-free operation, full legal compliance in every jurisdiction or complete protection against all threats.
Nothing in these Terms excludes warranties that cannot be excluded under applicable consumer protection law.
12. Limitation of liability
To the maximum extent permitted by law, NomaPort will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business interruption, even if advised of the possibility.
Our aggregate liability arising out of or relating to any order, subscription or these Terms will not exceed the greater of (a) the amounts paid by you to NomaPort for the specific service giving rise to the claim during the twelve (12) months before the event, or (b) one hundred euros (EUR 100) for free or trial use.
These limits do not apply to liability that cannot be limited under mandatory law, including death or personal injury caused by negligence or fraud.
13. Indemnity
You will defend, indemnify and hold harmless NomaPort and its personnel from claims, damages, losses and expenses arising from your unlawful use of the services, breach of these Terms, misuse of VPN or connectivity features, infringement of third-party rights or violation of applicable telecommunications or export rules, except to the extent caused by our wilful misconduct.
14. Suspension and termination
You may stop using NomaPort at any time and may cancel subscriptions through the billing portal unless a separate contract applies. We may suspend or terminate access for non-payment, security incidents, legal requirements or material breach after notice where reasonable.
Upon termination, your right to use affected services ends. Provisions that by nature should survive will survive, including payment obligations, confidentiality, disclaimers, liability limits and governing law.
15. Changes to these Terms
We may update these Terms to reflect product, legal or operational changes. We will post the updated version on our website and update the 'Last updated' date. Material changes to paid subscriptions will be communicated with reasonable notice when required by law. Continued use after the effective date constitutes acceptance unless mandatory law requires explicit consent.
16. Governing law and disputes
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules. If you are a consumer resident in the European Union, you also benefit from mandatory protections of your country of residence.
Disputes should first be raised with us at legal@nomaport.com so we can attempt good-faith resolution. Subject to mandatory consumer rights, the competent courts in the Netherlands have exclusive jurisdiction unless applicable law requires otherwise.
EU consumers may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
